However, different reporting requirements depend on who you communicate with and their legal obligations to share the information as a mandatory reporter. For example, we have clergy members who, according to Florida Law 90.505, “A communication between a member of the clergy and a person is “confidential” if made privately for the purpose of seeking spiritual counsel and advice from the member of the clergy in the usual course of his or her practice or discipline and not intended for further disclosure except to other persons present in furtherance of the communication.” Others who do not operate in this capacity may be required by law to report:

1. If a client threatens or attempts to commit suicide or otherwise conducts themselves in a manner with a substantial risk of incurring severe bodily harm.
2. If a client threatens grave bodily harm or death to another person.
3. If the therapist has a reasonable suspicion that a client or other named victim is the perpetrator, observer of, or actual victim of physical, emotional, or sexual abuse of children under the age of 18 years.
4. Suspicions, as stated above, in the case of an elderly person who may be subjected to these abuses.
5. Suspected neglect of the parties named in items #3 and # 4.
6. If a court of law issues a legitimate subpoena for information stated on the subpoena.
7. If a client is in therapy or being treated by order of a court of law, or if the information is obtained to render an expert’s report to an attorney.

It is best to ask the individual you are communicating with what their legal requirements are if you have any questions. 

Unless required by law, your information is not shared. Occasionally we may need to consult with other professionals in their areas of expertise to provide the best resources for you. Information about you may be shared in this context without using your name. If your data is utilized in research, your name will not be included. Under no circumstances will we sell information to others. If applicable, only sharing will occur in scientific or professional publications. In most cases, you will be made aware if the data is being collected for research purposes.
